Day Wins Settlement in Turfway Whip Suit

Jockey Pat Day has won a settlement in a lawsuit filed in connection with the Turfway Park Breeders' Cup Handicap on Sept. 16, 2000.
The suit accused Day of negligence in his use of the whip during the race, which Day won aboard the filly Spain. James T. Hines, owner of second-place finisher Ruby Surprise, claimed Day struck his filly with his whip and caused her to lose the race.
According to the Cincinnati Enquirer, Hines agreed to pay a total of $1,532.90 to Day and three Turfway stewards also named in the suit. Day called the lawsuit, which was settled Nov. 1, "ludicrous," the newspaper reported.
