Criminal Charges Filed in New York for Milkshaking

Nassau County police arrested three men at Belmont Park last week for allegedly administering a milkshake June 28 to a horse scheduled to run that day for trainer Gary Sciacca.Paul Barone, Sciacca's assistant, stable foreman Oscar DeLeon, and Belmont Park veterinarian Dr. Jack McGuire were each arrested and charged with tampering with a sports contest, which is a misdemeanor. All three were later released and an arraignment date of July 17 has been set for First District Court in Hempstead.Sciacca, who is not facing any criminal charges according to police, is on vacation until Tuesday and was unavailable for comment. The New York Racing Association will hold a preliminary hearing into the case Tuesday morning.According to the police report, an NYRA investigator observed the three men administering a milkshake to Storm River Kelly the morning he was to race. State rules allow for no medication or other substances to be administered to a horse on raceday other than Lasix.Blood and urine samples from Storm River Kelly were taken for testing but the results are not yet known, said a spokesperson for the New York State Racing and Wagering Board. NYRA president Terry Meyocks said criminal charges of tampering with a sports contest were filed because the milkshake ingredients of sugar and soda bicarbonate will not trigger a positive test anyway, which makes it different from a post-race drug positive that is generally disciplined in-house.
